This webinar will review the current status of regulation of groundwater discharges that are hydraulically connected to Waters of the United States and potentially subject to regulation under the Clean Water Act (CWA). There have been two recent (in 2018) court rulings regarding groundwater regulation, one concerning injected treated wastewater that eventually discharges to the ocean in Hawaii, and one concerning a gas spill that resulted in discharge into adjacent wetlands and creeks, both deciding the claims were covered by the CWA. The legal findings are ambiguous in terms of future regulation, and the technical and regulatory challenges could be substantial. Speakers will summarize the status, including potential response from EPA, which recently issued a request for comments regarding the CWA language on the issue.
